Preorder Terms.

These Preorder Terms apply to physical products identified as preorders and purchased directly through www.tahiirahhabibi.com, operated by Statements By Habibi, doing business as Tahiirah Habibi (“Tahiirah Habibi,” “we,” “us,” or “our”).

These Terms supplement our Terms of Use, Shipping & Delivery Policy, and Returns, Refunds & Cancellation Policy.

If a specific preorder page contains terms that differ from these general Preorder Terms, the more specific terms disclosed for that preorder control.

1. What a Preorder Is

A preorder is a purchase of a product before that product is ready for ordinary shipment.

By placing a preorder, you understand that the item is not available for immediate shipment and that fulfillment will occur at a later date or during the estimated fulfillment period shown on the applicable product page.

2. Preorder Information

Before completing a preorder, the applicable product page or checkout should identify the material terms of the offer, including as applicable:

  • the product or edition;

  • preorder price;

  • estimated fulfillment or shipping timeframe;

  • whether shipping is included or charged separately;

  • applicable taxes;

  • any additional payment that may become due before shipment;

  • cancellation and refund terms;

  • whether the item is limited, numbered, signed, personalized, made-to-order, or otherwise subject to special conditions; and

  • any final-sale restriction where legally permitted.

Please review these terms carefully before placing a preorder.

3. Estimated Fulfillment

The estimated fulfillment or shipment period shown when you place your preorder is based on information reasonably available to us at that time.

Publishing, printing, manufacturing, production, freight, materials, quality-control, supplier, or other operational circumstances may affect fulfillment timing.

Unless expressly stated otherwise, an estimated fulfillment date or range is not a guaranteed delivery date.

We will not intentionally publish a shipping or fulfillment estimate unless we have a reasonable basis for that estimate.

Federal rules generally require online sellers of merchandise to have a reasonable basis for any advertised shipment timeframe. If no shipment timeframe is stated, sellers generally must have a reasonable basis to expect shipment within 30 days.

4. Delays

If we learn that we cannot ship a preorder within the timeframe promised when the order was placed, we will provide any notice, revised shipping information, cancellation option, consent request, or refund required by applicable law.

Federal rules generally require sellers who cannot ship merchandise when promised to notify the buyer and provide the choice required by law between accepting the delay and canceling for a refund.

If we determine that we will not be able to fulfill the preorder, we will cancel the affected order and issue the refund required by applicable law.

5. Shipping Charges

Shipping is not included in a preorder price unless the applicable product page expressly states that shipping is included.

Where disclosed before purchase, shipping charges may be calculated and collected separately when the product is ready for shipment.

The applicable preorder page should clearly explain whether:

  • shipping is paid at the time of preorder;

  • shipping is included in the stated price; or

  • shipping will be collected later.

You should not place a preorder if you do not agree to the disclosed shipping arrangement.

6. Taxes

Applicable taxes may be collected at the time of the preorder or at another clearly disclosed stage of fulfillment, depending on the transaction, destination, checkout configuration, and applicable law.

Taxes may change if the final shipping destination or other relevant transaction information changes before fulfillment.

7. Additional Amounts Due Before Shipment

If a preorder is structured so that shipping, taxes, or another expressly disclosed amount will be collected later, we may contact you before shipment with payment instructions.

We will not add an undisclosed product charge merely because the product is ready to ship.

If a required future charge was clearly disclosed as part of the original preorder, failure to complete that payment may prevent fulfillment.

Any cancellation or refund resulting from nonpayment will be handled under the terms disclosed for the applicable preorder and applicable law.

8. Address Confirmation

Because significant time may pass between preorder and shipment, we may contact you before fulfillment to confirm your delivery address.

You are responsible for keeping your contact and shipping information current.

If your address changes before shipment, contact us as soon as possible.

We cannot guarantee that an address can be changed once an order has entered final fulfillment or has been transferred to a carrier.

9. Product and Production Changes

Product photographs, digital mockups, samples, prototypes, renderings, and preliminary designs may represent the intended product but may not reflect every characteristic of the final production item.

Reasonable production variations may occur in areas such as color, materials, printing, binding, packaging, dimensions, or other nonessential production details.

We will not intentionally substitute a materially different core product or materially reduce specifically promised features without providing appropriate notice and any remedy required by applicable law.

10. Limited and Collector Editions

If a preorder is advertised as limited, numbered, signed, first edition, collector edition, or otherwise collectible, the applicable claim must accurately reflect the product being offered.

The product page will control regarding specific inclusions, edition details, signatures, numbering, packaging, additional materials, or other collector features.

Purchasing a limited or collector product does not guarantee future resale value, investment value, appreciation, scarcity in secondary markets, or collectibility.

11. Personalized, Custom, or Made-to-Order Products

Products that are personalized, customized, individually produced, signed for a particular purchaser, or otherwise made specifically for an order may be subject to different cancellation or return restrictions where permitted by law.

Any such restriction must be clearly disclosed before purchase.

These restrictions do not eliminate rights concerning products that arrive defective, damaged, incorrect, or materially different from what was ordered where applicable law provides a remedy.

12. Cancellation by the Customer

The applicable preorder page will disclose whether customer-requested cancellation is permitted before fulfillment.

If cancellation is permitted, you must request cancellation before the order reaches the stage identified in the applicable offer.

Because production or allocation may begin before shipment, we cannot guarantee cancellation once a preorder has entered final production, personalization, allocation, or fulfillment where the disclosed terms lawfully restrict cancellation.

Nothing in this section eliminates a cancellation or refund right required by applicable law.

13. Cancellation by Us

We may cancel a preorder if:

  • the product cannot reasonably be produced or supplied;

  • inventory or production capacity becomes unavailable;

  • a material pricing or product-listing error occurred;

  • fulfillment becomes unlawful;

  • fraud or unauthorized payment is reasonably suspected;

  • a required payment cannot be completed; or

  • another circumstance makes fulfillment impracticable.

If we cancel an order after collecting payment, we will provide the refund required by applicable law.

14. Refunds for Unfulfilled Merchandise

Where applicable federal law requires cancellation and refund because merchandise cannot be shipped as promised, the required remedy is generally a refund rather than store credit.

Any approved refund will generally be issued to the original payment method where reasonably available.

Processing time after we issue a refund may depend on the payment provider or financial institution.

15. Final Sale Designations

A preorder is not automatically final sale merely because it is a preorder.

If a particular limited, customized, collector, signed, numbered, or made-to-order product is designated as final sale, that restriction must be clearly disclosed before the customer completes the purchase.

A lawful final-sale restriction does not eliminate rights that cannot legally be waived, including applicable remedies for non-delivery, defects, damage, incorrect items, or materially misrepresented products.

16. Haute Pairings and High Taste Products

The Tahiirah Habibi website may promote Haute Pairings and other products associated with High Taste.

If a Haute Pairings preorder is purchased through a separate High Taste website, checkout, or platform, the terms presented through that High Taste purchase flow control.

For Haute Pairings, shipping must not be described as included unless the specific offer expressly states that it is included.

Where clearly disclosed before purchase, shipping charges and applicable taxes may be collected when the product is ready to ship.

17. Third-Party Fulfillment

We may use third-party manufacturers, printers, fulfillment providers, carriers, or other service providers to produce or deliver preorder merchandise.

Use of a service provider does not eliminate our obligations to customers under the applicable transaction terms and law.

18. Contact and Order Communications

We may contact preorder customers regarding:

  • fulfillment timing;

  • delays;

  • address confirmation;

  • required shipping information;

  • properly disclosed amounts due before shipment;

  • production updates;

  • cancellation options;

  • refunds; or

  • other information necessary to complete the order.

These communications are transactional and may be sent even if you have opted out of unrelated marketing communications.

19. No Guarantee of Resale or Investment Value

Preorder products, including limited and collector editions, are sold as consumer products and not as financial investments.

We do not guarantee future resale value, market demand, appreciation, scarcity, or investment performance.

20. Governing Law

These Preorder Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where mandatory consumer-protection law requires otherwise.

22. Changes to These Terms

We may update these Preorder Terms prospectively.

The terms applicable to an existing preorder will generally be the terms presented when that preorder was placed, together with any product-specific disclosures accepted as part of that transaction.

We will not retroactively impose a material disadvantage on an existing preorder except where permitted by law.
